Fresh suit received from filing counter. It be checked and
registered as per rules.
Present: Mr. Gaurav Dhyani, Ld. Counsel for the plaintiff.
Heard. Record perused.
The suit is seen to be filed under Order 37 CPC.
However, as per the ledger account, there are shifting balances
qua several invoices raised and multiple part payments made by
the defendant, culminating into the outstanding due of Rs.
37,416/- for which the present suit has been filed. In view of the
same therefore, suit cannot be continued as summary suit. Ld.
Counsel for the plaintiff states that it may instead be treated as an
ordinary suit.
Considering the above, the present suit is
converted into an ordinary suit going forward.
Part cause of action is sought to be made out within
the territorial jurisdiction of this court considering bank account
of the plaintiff being situated at Keshav Puram, Lawraence Road,
Delhi-110035. Submissions in that regard is found to be in order.
Let summons be issued to the defendant on filing of
PF / RC / through all prescribed modes returnable for NDOH.
Re-list on 12.05.2026.
