Counsel for plaintiff has straightway advanced arguments
on application u/s 5 Limitation Act.

Record shows that defendant no.2 was served on
04.05.2024 and thus, written statement has been filed beyond the
period of 90 days. Still in the interest of justice, the delay in filing
the written statement is condoned subject to cost of Rs.1000/- to be
paid to the plaintiff.
It is submitted by defendant no.1 and 3 that he has not
received the legible copy of the plaint. Same has been supplied
today in the court.
Written statement be filed on behalf of defendant no.1
and 3 within statutory period with advance copy to the opposite
party.
