Undersigned is having pendency of approximately 8400 cases in
this court.
Present: Sh. Droan Dutt and Ms. Harshita Rawat Ld. Counsel
for complainant along with complainant.
Part arguments heard.
Ld counsel has submitted that the victim had made
the complaint on the very day of the incidence and called the
police officials from the place of incidence itself. It is further
submitted by ld counsel for the complainant that as per the ATR
also the presence of proposed accused and complainant herein is
not denied. However, ATR is silent with respect to the
commission of offence stating that statements of the employees
of the company were recorded. Ld counsel has further argued
that the statements of employees of the company shall not be
relied upon as same are interested witnesses and the other
persons who were present are anyway proposed accused in the
present complaint.
Ld cousnel for complainant has further argued that
there are catena of judgments that once the allegation of sexual
offence are made out the investigating agency just have to see
that whether any prima facie is made out, however, in the present
case, the investigating agency has just conducted preliminary
inquiry which is bad in law as the matter pertains to the sexual
offence.
