Smt Zareena, mother of accused/applicant in person.
This is second bail application filed on behalf of accused
Sameer S/oSh Mainuddin.
Mother of accused submits that their counsel merely filed this
application and is not appearing and prays that the application be allowed.
She has been assisted by Ld. LADC upon directions of this court.
Ld. LADC for accused submits that the first bail application of
accused was withdrawn, recovery was not effected from the possession of
the accused and prays that he be released on bail.
Ld APP for the State opposed the bail application.
Security officer has placed on record copy of order dated
31.01.2026 passed by Hon’ble High Court of Delhi dismissing the bail
application of co accused Shivam and opposed the bail application strongly.
Heard.Perused.
This is second bail application preferred on behalf of accused
Sameer. Charge sheet has been filed and the matter is fixed for arguments on
charge. Applicant Sameer is accused of theft of metro cable and trespassing

on the metro tracks. Even part recovery has been made from co accused
upon whose disclosure statement, accused Sameer was apprehended.
Accused Sameer is involved in many of the similar types of cases as
transpires from the charge sheet. Even part recovery has been made from the
present accused, as per supplementary charge sheet. Allegations leveled
against accused have implication of endangering the safety of public at
large. Even bail application of co accused has been dismised by Hon’ble
High Court of Delhi. Accordingly, this court does not deem fit to release
accused Sameer @ Chuha on bail. Accordingly, bail application stands
dismissed.
