This is first appearance of accused.
Considering the nature of offence, accused is admitted to
bail on furnishing of PB/SB in the sum of Rs. 5,000/- with one surety
in the like amount. Bail bond furnished and accepted.
Bail bond not furnished. Accused has undertaken that he
will furnish the bail bond on the NDOH.
There is sufficient material on record to prima facie
reach a conclusion that an offence u/s 138 of the NI Act seems to have
been committed by the accused. Accordingly, a notice of accusation
u/s 251 Cr. P. C for offence u/s 138 of the NI Act is served upon the
accused to which he pleaded not guilty and claimed trial.
At this stage, statement of accused u/s. 294 Cr.P.C.
recorded. In view of the statement, complainant has dropped the
witness from serial no. 7 to 10.
Considering the defence disclosed, need for moving
formal application u/s. 145(2) NI Act is dispensed with and accused is
granted opportunity to cross examine the complainant/AR through his
counsel on NDOH.
Further, it appears that evidence may need to be
recorded in detail in this case and therefore, the present case shall be
tried as a summons case.
