Complainant has been apprised of the court requirement to submit the
original documents including the dishonoured cheque, dishonour memo bearing the seal
of the bank, legal demand notice, dispatch receipt and service proof, reply, if any, E-filing
history etc. apart from physically signed original complaint and attested affidavit of pre-
summoning evidence, with the reader-cum-ahlmad of the court, within two weeks.
Certificate u/s 63 BSA 2024 be also filed in support of electronic record.
In terms of provision of BNSS, let court notice be issued to proposed
accused to afford an opportunity of hearing, on filing of PF within 7 days, returnable for
NDOH.
In case of refusal/premises found locked and upon proper verification as to
the said address of accused, let the court notice be served through affixation and pictures
be annexed alongwith the report. Process server is directed to annex the proof of service
alongwith the report.
Ld. Counsel for the complainant also submits that he/she will get the court
notice served upon the proposed accused either physically/electronically. Let the same be
done upon appropriate affidavit of service. At request, copy of the court notice be also
given as dasti at least one month before NDOH.
Complainant is directed to visit the Digital Court Work Station for
submitting the physical file between 2.00 to 4.00 p.m.
