This is an application seeking bail of accused/applicant Raj moved
on behalf of the applicant/accused.
It is submitted that the applicant has been falsely implicated in this
case and has nothing to do with the alleged offence. It is further submitted that
the applicant is in JC since 09.02.2025 and is no more required for the further
investigation. It is further submitted that the applicant would appear before the
court on the date fixed and would not interfere with the investigation in any
manner.
Per contra, Ld. APP for State has opposed the bail application of
the applicant stating that there are chances that applicant may jump bail and may
commit similar offence in future.
Heard. Record perused.
In the present case, charge sheet has already been filed, PW
complainant has already been examined and the applicant is in JC since
09.02.2025 and as such evidently he is not required for further investigation.
As such court bail is granted to the accused Raj on furnishing B/B
and S/B in the sum of Rs. 10,000/- with one surety of like amount and further
subject to the condition that accused shall not indulge in offence of similar
nature.
B/B and S/B not furnished.
Hence, the application stands disposed off.

Report has been filed by the concerned JS where it has been stated that
the accused has remained in custody for 3 years, 6 months and 2 days in the present
FIR.
Ld. counsel for accused/applicant submits that the allegations against the
accused are for commission of an offence U/s. 387/336/120B of IPC and U/s. 25/27 of
Arms Act which is punishable with maximum imprisonment of upto 7 years and
accused is entitled to benefit U/s. 436A of Cr.PC.
Per Contra, Ld. APP for State submits that the allegations against the
accused are for commission of a grievous offence and accused be not released on bail.
Heard. Perused. Considered.
Perusal of record shows that the matter is at the stage of consideration on
charge and Ld. counsel for accused Himmat @ Chiku has remained present before this
court and further the matter has been pending for consideration on charge on account of
delay caused by other co-accused. Further perusal shows that other co-accused persons
are already on regular court bail.
Accused Himmat @ Chiku has already remained in custody for more
than half of the maximum sentence for the offence U/s. 387/336/120B of IPC and U/s.
25/27 of Arms Act and therefore, accused Himmat @ Chiku is entitled to benefit U/s.
436A of Cr.PC.
Court bail is granted to accused Himmat @ Chiku on furnishing personal
bond in sum of Rs. 20,000/- with one surety of like amount.
Bonds not furnished today.
Application is accordingly disposed off.
Copy of this order be given dasti.
