The matter was fixed on the day of holiday i.e. 13.03.2025 and is taken up on next working
day i.e. 17.03.2025.
Present: Sh. Pankaj Kumar, Ld. proxy counsel for complainant through VC.
None for proposed accused.
Court notice issued against the proposed accused received back stating that
Whatsapp service stated to be not available on the given mobile number. Screenshot annexed.
In terms of provision of BNSS, let fresh court notice be issued to proposed
accused PHYSICALLY to afford an opportunity of hearing, on filing of PF within 7 days,
returnable for NDOH.
Executing officer is further directed to make at least three visits on different
dates, in case of non-availability of accused on a given address/addresses. The report of each
visit be furnished before the court, failing which the strict action shall be taken against the
executing officer.
In case of refusal/premises found locked and upon proper verification as to the
said address of accused, let the court notice be served through affixation and pictures be
annexed alongwith the report. Process server is further directed to annex the proof of
electronic service alongwith the report.
Ld. Counsel for the complainant also submits that he/she will get the court
notice served upon the proposed accused either physically/electronically. Let the same be
done upon appropriate affidavit of service. At request, copy of the court notice be also given
as dasti at least one month before NDOH.
Put up for further proceedings on 24.07.2025.
JA concerned is directed to specifically mention the fact about service of
court notice physically upon the process.
Copy of this order be also sent to the process server for necessary intimation.
