In terms of provision of BNSS, let fresh notice be issued to
proposed accused to afford an opportunity of hearing, on filing of PF within 30
days, returnable for NDOH.
Executing officer is further directed to make at least three visits on
different dates, in case of non-availability of accused on a given
address/addresses. The report of each visit be furnished before the court, failing
which the strict action shall be taken against the executing officer.
In case of refusal/premises found locked and upon proper
verification as to the said address of accused, let the notice be served through
affixation and pictures be annexed alongwith the report. Process server is further
directed to annex the proof of electronic service alongwith the report.
Ld. Counsel for the complainant also submits that he/she will get
the court notice served upon the proposed accused either
physically/electronically. Let the same be done upon appropriate affidavit of
service. At request, copy of the notice be also given as dasti at least one month
before NDOH.
