Present: Ms. Tanya Uppal, Ld. APP for the State.
Accused Sonu in person (stated to be on court bail).
Ms. Mokshada Aggarwal, Ld. LADC for accused.
Summons issued to the accused received back as received by mother.
Accused has appeared and submits that the address on which the
summons were sent is his correct address.
Accused has further submitted that he is unable to engage a private
counsel due to financial difficulty.
In view of the same, Ld. LADC attached to this court shall assist the
accused.
Ld. LADC for accused submits that accused has received the complete
and legible copy of charge sheet and documents. Therefore, SD is complete.
Ld. LADC for accused submits that she has no objection if charge is
framed against the accused today itself.
Case file has been perused. Submissions heard.
Prima facie case for offence punishable u/s. 379 of IPC and in alternative
U/s. 411 of IPC has been made out against the accused. Charge for the aforementioned
offence has accordingly been framed against the accused today itself which was read
over and explained to the accused. The accused has pleaded not guilty and has claimed
trial.
During admission / denial of documents under Section 294 Cr. PC,
accused has not disputed the genuineness of FIR no. 17/24 PS NSP Metro, Endorsement
on rukka and Certificate U/s. 65B of Indian Evidence Act regarding the present case,
without admitting their contents. Separate statement of accused has been recorded in
this respect.
In view of the above, witnesses at Sl. no. 4 in the list of prosecution
witness is dropped.
Let fresh summons be issued to complainant Jishan for all available
addresses through IO/SHO concerned for NDOH and let mobile number i.e.
9930359336 be also mentioned on the summons.
Be put up for PE on 16.04.2026.
