In light of recent judgment of Hon’ble Supreme Court in the case of Sanjabij
tari vs. Kishore S. Borcar and another decided on 25.09.2025, the requirement of accused
to be heard at stage of pre cognizance stands dispensed with.
Perusal of record reveals that complainant has filed the present complaint
against two accused persons namely Shailender Prasad and Anita Mehta for two separate
cheques belonging to them. It is submitted by ld counsel for complainant that the complaint
pertains to same transaction. Complainant is directed to place on record relevant authorities
whereby a single complaint can be filed to accused persons.
Put up for consideration on the point of summoning on 08.12.2025.
