Accused no. 1 Partnership firm absent.
Accused no. 2 Sumit Kumar absent. (cognizance qua accused no. 3 and 4 was
declined).
Matter is fixed for appearance of accused and consideration on notice.
No report on Summons issued against the accused received back despite the
process being issued on 28.03.2024.
Tracking report filed with the remark “insufficient address “.
Ld. Counsel for the complainant submits that the address which was provided by
accused partnership firm in the agreement between complainant and the accused firm, at page
no. 21, 22 is the same address on which the summons were sent. He further submits that the
GST certificate of accused firm at page no. 27 also mentions the same address.
In view of the above, let fresh summons be issued in terms of previous order on
filing of fresh PF/RC within two weeks from today returnable on 06.01.2025. Complainant is
directed to file a tracking report alongwith 65 B certificate before NDOH.
Complainant is permitted to do dasti service of summons.
At joint request, put up for consideration on notice on
