During the course of arguments, Ld. Counsel has
submitted that there are specific allegations against the proposed
accused persons under SC/ST Act. Ld. Counsel has also
submitted after taking instructions from the complainant that
proposed accused persons are not members of the SC/ST
community.
As such since there are allegation of commission of
offence under the SC/ST Act, the court does not have the
jurisdiction to entertain this complaint. Accordingly, let the file
be put up before Ld. Principal District & Sessions Judge, North
West, Rohini Courts, Delhi on 17.01.2025 at 02.00 pm with a
request to pass appropriate orders.
