Vide order dated 04.01.2025, summons were issued to the bank official.
Statement of the concerned bank official has been recorded, he is examined and
discharged.
Upon perusal of the compliant, the legal demand notice returned unserved to the
complainant on 18.10.2023. There is no proof whether the demand notice was served upon the
accused or not.
Ld. Counsel for the complainant is directed to move an appropriate affidavit verifying
that the accused is residing at the same address only, where the demand notice was served in
compliance of judgement of Hon’ble Delhi High Court in case titled as
HDFC Bank ltd. V.
Amit Kumar Singh, 2009 and in mandate of judgement of the Hon’ble Supreme Court in
CC.
