Proceedings are conducted through VC using CISCO Webex
Meeting App.
File is taken up on an application seeking cancellation of B/Ws
moved on behalf of accused.
Present : Ld. Counsel Sh. Amit Shrivastava for accused.
Accused Girish at workstation.
The perusal of the application reveals that the accused
was not aware about any complaint for the offence of dishonour of
cheque being filed by the complainant against him. It further states
that the complainant is falsely implicating the accused by misusing the
cheque in question. The default in appearance of the accused is due to
lack of knowledge of any such criminal proceedings pending against
him.
In view of the above, B/Ws stands cancelled.
Ld. Counsel for accused has submitted that copy of
complaint has not been received by the accused. Let the C/N be issued
to the complainant to supply the copy of complaint and annexed
documents to the accused on e-mail ID i.e.
advamitsrivastava3406@gmail.com. well in advance before the
NDOH.
Since the offence is bailable, accused is admitted to bail
on furnishing bail bond in the sum of Rs.10,000/- with one surety in
the like amount. Accused is directed to file scanned copy of bail bond
today itself and to file hard copy of surety bond today itself. Ld.
Counsel undertakes to furnish bail bonds today itself.
Put up for consideration on notice on the date already
fixed i.e. 27.03.2025.
