Matter is fixed for consideration and arguments on summoning.
Present matter has been received by way of transfer from DC-03.
It was observed by the previous court that there are four accused persons namely
Kalu Ram Dhingra, M/s Dhingra Associates, Aakash Dhingra and M/s World Link Corporation.
Two of the cheques have been issued from the account of M/s Dhingra Associates (signed by
accused no.1 & 3) and three from that of M/s World Link Corporation (signed by accused
no.3).
It is pertinent to note that accused no. 2 & 4 are separate proprietorship firms.
Ld. Counsel for the complainant has relied upon certain sets of judgment shared
at court's email ID which shows that multiple cheques if issued in same transaction by different
accused persons can be tried in one complaint. He further submits that in the present matter the
son and the father issued the cheques in same transaction for which a common legal notice was
served.
