Present complaint pertains to cheque bearing no. 000478.
Notice u/s 251 Cr.PC has been framed against the accused. Accused
pleads not guilty and claims trial. Admission/denial of document u/s 294 Cr.PC done.
Witness no. 2 and 3 stands dropped from the list of witnesses. Signed notice received
back.
This court further does not deem it appropriate to try the case summarily
since sentence for imprisonment exceeding one year may have to be passed, if trial
results in conviction, this case would be tried as summons trial case.
Ld. Counsel for accused orally pleaded u/s 145(2) NI Act that he wishes
to cross examine the complainant. Ld. Counsel for the complainant is not opposing the
same. Therefore, oral application is allowed.
At this stage, both the parties express their willingness to explore the
possibilities of settlement before Mediation. After taking consent of both the parties,
the matter is referred to Mediation Cell, Rohini.

Both the parties are directed to remain present before Mediation on
31.08.2024 at 12 PM.
Both the parties have been apprised that non-appearance before
Mediation will result in imposition of cost upon the defaulting party.
