Present : Ld. Counsel Sh. Kapil Singhal for complainant at THC.
None for accused.
Ld. Counsel for complainant submits that on 27.08.2024
last and final opportunity was given to the accused to move an
application u/s. 145(2) of N.I. Act. He further submits that only
personal bonds have been furnished by the accused who has defaulted
appearance on the previous dates. He further submits that cost of
Rs.1500/- have not yet been received by the complainant.
The reader of the court has informed that only personal
bonds and vakalatnama have been placed on record. The softcopy of
the signed notice has been received however the hardcopy of the same
has not been placed on record yet.
Heard.
The perusal of the previous ordersheets reveal that
despite last and final opportunity being given on 27.08.2024 for the
filing of application u/s. 145(2) N.I. Act the accused has not only
defaulted appearance on 27.08.2024, 13.12.2024 and today i.e.
07.01.2025, but also not placed any application on record.
In view of the submissions made above and perusal of
the previous ordersheet, the right of the accused to cross-examine the
complainant stands closed.
Simultaneoulsy, let NBWs be issued against the accused
through SHO concerned on filing of PF to be filed within 10 working
days from today for NDOH.
