Sh. Anil Yadav, Ld. Counsel alongwith accused in person.
Surety bonds not filed till date. Even on LDOH a cost of Rs. 200/- ( to be
deposited in DLSA) was imposed on accused for non furnishing the surety bonds. Last and
final opportunity is granted to the accused to furnish the surety bonds subject to a further cost
of Rs. 1000/- (to be paid to complainant). Let the bonds be furnished within two days.
Personal bonds be filed during the course of the day.
Exemption was allowed on LDOH subject to furnishing of medical documents.
It is submitted by the accused that he was suffering from viral fever on LDOH. However, on
LDOH it was submitted that the accused had loose motions. From this, it is apparent that the
conduct of the accused is not praiseworthy. He is warned to be careful in future.
Notice u/s 251 Cr.PC has been framed against the accused. Accused pleads not
guilty and claims trial. Admission/denial of document u/s 294 Cr.PC done. Witness no. 2 and
3 stands dropped from the list of witnesses. Signed notice received back.
This court further does not deem it appropriate to try the case summarily since
sentence for imprisonment exceeding one year may have to be passed, if trial results in
conviction, this case would be tried as summons trial case.
Ld. Counsel for accused orally pleaded u/s 145(2) NI Act that he wishes to
cross examine the complainant. Ld. Counsel for the complainant is not opposing the same.
Therefore, oral application is allowed.
Put up for CE on 06.03.2025 at 12:00 PM.
Date and time are fixed as per convenience of both parties.
Required persons i.e. complainant, Ld. Counsel for the complainant and Ld.
Counsel for accused are directed to be physically present from court no. 104, Extension
Block, Tis Hazari Courts.
