Sh. Sonu Jha, Ld. Counsel for the accused alongwith accused no. 2.
Accused no. 1 is a company.
Accused no. 3 was dropped from the present proceedings vide order dt.
06.03.2024.
Vide order dated 01.02.2025 NBWs were issued against the accused no. 1 and 2.
However the accused has appeared today.
Accused submits that due to bereavement in his family he could not appear before the
court.
No proof of the same has been placed on record.
On account of appearance of the accused, NBWs issued against him stands cancelled
subject to cost of Rs. 500/- to be paid to the complainant on the next date of hearing.
AR of the Complainant has confirmed the identity of the accused no. 2 who is appearing
through VC.
Adjournment is sought on behalf of the accused on the ground that the accused is
unwell.
Medical documents have been filed.
Further, Ld. Counsel for the accused submits that due to difficulty in language Notice
may not be framed today against the accused through VC.
Accordingly, matter stands adjourned however no adjournment shall be given for the
purpose of framing of notice on the next date of hearing.
