Perusal of record shows that accused no.2 has not been
summoned.
Notice u/s. 251 Cr.P.C is framed separately against the
accused no.1 through accused no.3 and accused no.3 to which he
pleaded not guilty and claimed trial. Vide separate statement, accused
has admitted certain documents u/s. 294 Cr.P.C. In view of the same,
witnesses mentioned at Sr. No. CW-2 and CW-3 are hereby dropped.
Copy of notice and statement u/s. 294 Cr.P.C. are sent to the accused
and counsel on their e-mail ID. Accused is directed to sign and send
back the scanned copy of notice and statement. Let the hardcopy of the
same be filed at the workstation before the NDOH.
Ld. Counsel for complainant has no objection if the oral
request of accused u/s. 145(2) N.I. Act is allowed without prejudice.
Considering the no objection, oral request of accused u/s. 145(2) N.I.
Act is allowed.
Both the parties have submitted that there are chances for
settlement. Considering the submissions of parties, let the matter be
referred to Mediation for 09.09.2024 at 2:00 PM. Both the parties are
directed to sign the mediation form in the Court before the mediation
date.
Ld. Counsel for complainant has submitted that an
application u/s. 143-A N.I. Act was e-mailed on 27.08.2024. Let the
hardcopy be filed by NDOH. Copy of application be also supplied to
the accused.
Put up for settlement, if any / arguments upon aforesaid
application/ CE 25.11.2024 at 12:30 PM.
