Proceedings are conducted through VC using CISCO Webex Meeting App.
Present: Ld. Counsel for the accused alongwith accused.
Notice under Section 251 CrPC (now Section 274 BNSS) is framed against
the accused no.1 and 2to which they pleaded guilty and did not claim trial. Separate
statement under Section 294 CrPC (now Section 330 BNSS) also recorded. The accused
persons pleaded guilty and did not claim trial. Therefore, vide separare judgment, the
accused stands convicted and liable for offence punishable under Section 138 N.I. Act.
An application for waiver of cost has been moved by Ld. Counsel for the
accused.
Heard. Perused. Cost stands reduced to Rs.2,000/- to be paid today itself.
Ld. Counsel for the convict prays that due to financial hardship, the entire
amount cannot be paid at once.
The Ld. Counsel for the convict submits that the matter be referred to the
mediation to draw out a settlement for payment of the due amount in installments.
Let court notice be issued to complainant to intimate the date of mediation.
Both the parties are directed to appear in mediation on 05.03.2025 at 02:00
P.M.
Ld. Counsel for the complainant is directed to appear in mediation on date
fixed.
Put up for report on mediation / arguments on sentence on 25.03.2025.
