Perusal of record shows that first loan of Rs.50,000/- was
given on 28.03.2016 for a period of 11 months. It is further revealed
that 2nd loan of Rs.50,000/- was given in the month of June, 2017. As
such, there is no repayment period mentioned, hence, the debt i.e. the
loan could have been recovered till 2020, however, the cheque in
question has been issued in the year 2024. Apparently, the debt in
question ceased to be legally enforceable debt in the month of June,
2020. Hence, the complaint appears to be not maintainable.
Ld. Counsel has sought time for addressing arguments on
the point of maintainability.
