Matter is fixed for report on mediation/consideration on notice.
DD of Rs. 20 lacs was handed over which has been duly encashed. It was the
submission of the AR that further payment of Rs. 4 lacs shall be paid towards interest as well as
litigation charges.
It has been submitted that the mediation referral has not been signed by the
accused persons , however, they turned up before mediation.
In the present matter the court is facing continuous difficultly in getting the matter
settled. On a previous date of hearing, both the counsels were directed to make an effort to get
the matter settled between the parties, however, it was submitted that they did not contact each
other with regard to the settlement of the matter. In consideration of the guidelines laid down
by Hon’ble Supreme Court, the matter was referred before ,mediation. Despite passage of one
month, none of the counsels ensured that the mediation referral form is duly signed by the
parties within that time and the matter be referred before mediation in compliance of the order.
At this stage, both the counsels submit that the matter be re-referred before
mediation.
Heard. Cost of Rs. 200/-( to be deposited in DLSA) each is imposed on both the
parties for non compliance of the order.

At this stage, both the parties express their willingness to explore the possibilities
of settlement before Mediation. After taking consent of both the parties, the matter is referred to
Mediation Cell, Rohini.
Both the parties are directed to remain present before Mediation on 26.02.2024 at
2 PM.
Both the parties have been apprised that non-appearance before Mediation will
result in imposition of cost upon the defaulting party.
