Accused no. 1 is company being represented by accused no. 2 absent.
Accused no. 2 Prem Narayan Singh absent.
Accused no. 3 Sanjeev Singh through VC.
Accused no. 4 Yogesh through VC.
Matter is fixed for consideration on notice.
Exemption application has been moved on behalf of accused no. 2 on the ground that
he is traveling for work due to which he is unable to join VC proceedings.
Exemption of accused no. 1 and 2 is allowed for today.
DD of Rs. 20 lacs has been duly encashed. However, it was the submission of AR
that further payment of Rs. 4 lacs shall be paid towards the interest as well as litigation charges.
Both the counsels submit that they have not contacted each other with regard to
settlement of the matter.
At this stage, both the parties express their willingness to explore the possibilities of
settlement before Mediation. After taking consent of both the parties, the matter is referred to
Mediation Cell, Rohini.
Both the parties are directed to remain present before Mediation on 27.01.2024 at 12
PM.
Both the parties have been apprised that non-appearance before Mediation will result
in imposition of cost upon the defaulting party.
At joint request, put up for report on Mediation/consideration on notice on
17.02.2024.
