There are two accused in the present matter, the accused no. 1 is proprietor for the M/s Classic Boot House. It is the case of complainant that the material was supplied to proprietorship firm M/s Classic Boot House, however, the cheque has been issued by Mustaq Ali accused no. 2, the brother of accused no. 1 from the account of Mustaq Brothers. The legal notice in the present matter has been served only to accused no. 1 as being the proprietor of M/s Classic Boot House, with whom the complainant had the dealings and the material was supplied. No legal notice has been served to accused no. 2 who is the signatory to the cheque in question. Ld. Counsel for the complainant was directed to furnish the relevant authorities for further clarification on the said aspect. Today, Ld. Counsel for the complainant submits that settlement talks have been done and the cheque has been issued by the proposed accused. He therefore, seeks adjournment for today for verifying the payment received by proposed accused. Put up for further proceedings on 23.11.2023.
