Matter is fixed for consideration and arguments on summoning.
Ld. Counsel for the complainant has moved an application for
amendment in complaint viz. Firstly, the relation between complainant and accused,
the correction in date of return memo.
For clarification in the present matter and considering the illegible
return memos filed, Ld. Counsel for the complainant requests for calling bank witness
from accused bank.
Considering the examination of bank witness, the application for
amendment is kept pending till NDOH.
Issue summons to bank witness from accused bank to bring on record
the documents showing the reasons for the return of the cheque on filing of PF within
seven days, through concerned MD of the bank, returnable for 18.01.2025.
Complainant is directed to file the tracking report.
Complainant is also given permission for dasti service of summons.
At request, copy of this order be given as dasti.
