Perusal of the complaint shows that the present matter has been filed after
01.07.2024 and the same is governed by BNSS, 2023. As per proviso 1 to Section 223
of BNSS, it is mandatory to issue notice to the proposed accused before taking
cognizance.
Accordingly, notice be issued to the proposed accused u/s 223 BNSS Act
through all modes on filing of PF to be within 10 working days from today. The
process server is directed to serve the notice by way of affixation, if premises found
closed or same could not be served personally or on any adult male member.
Complainant is at liberty to accompany the process server.
Put up for appearance of the proposed accused and consideration on
03.06.2025.
