Present: Sh.Deepak Jindal, Ld. Counsel for complainant
through video conferencing.
Sh.Ankur Kaushik, Ld. Counsel for accused through
video conferencing.
Accused in person.
Today, copy of complaint along with annexed
documents have been supplied to the accused.
Heard on the point of notice. Prima facie case is made
out and accordingly notice framed against accused u/s 138 NI Act
to which accused plead not guilty and claim trial.
At this stage, admission/denial of documents under
Section 294 Cr. P.C. done. Accused states that they will not
dispute the genuineness and correctness of cheque in question and
return memo (without admitting contents thereof). Hence, witnesses
pertaining to the cheque in question and returning memo shall be
dropped from the list of witnesses by the complainant.
In view of the defence disclosed under notice of
substance of accusation, filing of application u/s 145 (2) NI Act is
hereby dispensed with and the accused is straightaway granted
opportunity to cross examine complainant witness in the matter.
Considering the nature of proceeding, present case be
tried as a summons triable case.
Complainant is directed to remain present on NDOH.
Put up for CE now on 30.10.2026.
