to the complainant, however, after the issuance of the cheque and before
presentation, the accused paid Rs.10,000/- to the complainant in respect
of the due amount. Admittedly, the complainant presented four cheques
of Rs.1 Lac (each) for encashment without making an endorsement of
Rs.10,000/- on any of the cheque. Ld. Counsel has argued that non-
making of endorsement on the cheque will not affect the case, as the due
amount is much more than the dishonoured amount which is Rs.4 Lacs
in total. Ld. Counsel has sought time for making further submissions on
the point of maintainability.
