An application under Section 151 of CPC is filed on behalf of
plaintiff for permission to amend the application under Section 5 of
Limitation Act.
The application is taken up for hearing.
Arguments are advanced.
The amendment is sought in order to specify the period of delay
in the application which is stated to have been inadvertently left out. No
prejudice would be caused to the defendant if the proposed amendment is
allowed which is only formal in nature. The application is allowed.
The amended application under Section 5 of Limitation Act read
with Section 151 of CPC dated 16.12.2025 is taken on record.
Main file has not been received. Let main file be summoned
from the record room afresh.
The pending applications shall be placed along with record of
the main file and shall be put up before this court on 12.01.2026.
Notice of the application under Order 9 Rule 9 of CPC and
application under Section 5 of Limitation Act read with Section 151 of CPC
dated 16.12.2025 be issued for service upon the defendant on filing of PF
within one day from today.
