Notice was issued to IO to supply the copy of charge sheet to
complainant. IO has filed report stating that the copy of charge sheet has been
supplied to husband of complainant on 22.02.2025.
Ld. Counsel for complainant submits that he will file the protest
petition during course of the day. On receipt of protest petition a copy be sent
to IO who shall file para wise reply on next date of hearing.
At this stage, it has been pointed out that there is mistake in last
order as the matter was listed for consideration and as the IO had mentioned in
the charge sheet that offence under Section 3 (1) (r) (s) & 3 (1) (w)(i) (ii) were
not found to have committed it was submitted that protest petition will be filed.
However, the order sheet also records that the cognizance has been taken on
the offence.
The matter was at consideration as protest petition was to be
filed. Therefore, the sentence that “I take cognizance of offence” is restricted
only against offence which has been mentioned in the charge sheet.
List for hearing on protest petition on 21.04.2025.
