It is stated by Ld. Proxy Counsel for plaintiff that
main counsel is coming from Tis Hazari Courts and is on the way
and request for passover of the matter is made. Opposed by
counsels for opposite parties stating that they cannot wait further
as they have to go to attend other matters also.
Considering the facts and to meet the ends of justice,
one last opportunity is granted to plaintiff to ensure the presence
of his counsel for arguments on application under Order 1 Rule
10 CPC.
Put up on 05.08.2025 for arguments on the
application under Order 1 Rule 10 CPC.
A cost of Rs. 3000/- to be paid to the defendant no.
1 to 3, Rs. 3000/- each to be paid to proposed defendant Kusum
and Yogesh is imposed upon the plaintiff as per Order 17 Rule 1
(2) CPC on account of adjournment of the matter today.
