It is submitted by the Branch Manager that KYC
documents of the defendant were available with the plaintiff bank.
However, inadvertently the complete particulars of the defendant
could not be filed on record.
Ld. Counsel for plaintiff bank sought adjournment to
file the amended memo of parties incorporating the complete details
of defendant.
Heard and allowed.
Let fresh summons for settlement of issues of the Suit
be issued to the defendant(s), on filing of PF, Speed Post, approved
courier & requisite Copies. Summons to be issued under
Order V
Rule 5 CPC 1908 upon the defendant(s) shall display mandatory
endorsement “
defendant should file his Written Statement of
defense within 30 days from the date of service / receipt of
summons alongwith the Statement of Truth and Affidavit of
admission/ denial of documents of the plaintiff as per Commercial
Courts Act, 2015”
