Notice of the execution petition at the local address
of the JD received back unserved with the report “
no such
person”.
Notice of the execution petition to the JD at the
outstation address vide registered cover received back with the
report “
refusal”.
At this stage, Ld. counsel for DH submits that
execution under consideration can only be executed against the
known address of the JD, which is outside the local jurisdiction
of this Court, praying for issuance of Transfer Certificate for
presentation before the Court of appropriate jurisdiction.
In the totality of the facts and circumstances of the
case and keeping in view the fact that JD does not have any
property situated within the jurisdiction of this Court, the request
of Ld. Counsel for DH for issuance of Transfer Certificate is
allowed, thereby invoking provisions under S. 39 r/w. S. 151
CPC and Order XXI Rule 6 CPC.
Accordingly, Certificate of Execution of Decree be
sent to the Court of appropriate jurisdiction alongwith Certificate
of Non-satisfaction of Decree alongwith order sending Decree to
Contd.. P/2

the Court of appropriate jurisdiction for Execution, be issued as
per rules.
In view of above, the present execution petition
stands disposed off as unsatisfied before this Court.
File be consigned to record room, after due
compliance.
