Fresh suit for recovery of Rs.1,00,99,811/- (Rupees one crore ninety nine
thousand eight hundred eleven only) received by way of assignment.
It be checked and registered.
Present: Sh. Varun Gupta, Ld. counsel for plaintiff through VC.
Heard. Record perused.
Ld. counsel for plaintiff has submitted that plaintiff has received
part-payment from defendant in the bank account situated in Rohini, Delhi
which is within the territorial jurisdiction of this court.
Ld. counsel for plaintiff further submits that the matter could not
be settled in the pre-institution Mediation proceedings. The certificate of
Non-Starter Report dated 18.08.2026 is on record. The Statement of Truth
is also on record.
Issue summons for settlement of issues in the matter against
defendant on filing of PF/RC, etc., through all permissible modes, returnable
for 02.02.2027. Steps be taken within 15 days from today.
Plaintiff is directed to arrange documents and particularly the
Statement of Account as they are not properly arranged.
