Summons issued to defendant no. 1 & 4 at their Sector-6 Rohini address could not be
served as it is reported that the premises have been rented out by him and he was not
available at the address. The process Server has also filed report in respect of the
Sector-9 address as per which the summons were served upon the defendants no. 1
and 4 on 09.01.2024.
Fresh Vakalatnama filed on behalf of Ld. Counsel for the defendant no.
2 and 3 and memo of appearance filed on behalf of defendant no. 5.
Ld. Counsel seeks time to file the WS. However, the same is opposed
by the Ld. Counsel for the plaintiff. As per record, all the defendants have been
served on 09.01.2024. The statutory period to file the WS is already expired. Hence,
their defence is struck off.
