no. 5.
Defendant nos. 1 and 3 in person.
Fresh vakalatnama is filed on behalf of defendant no. 5. It shall
be taken on record.
The plaint has been allowed to be amended by order dated
19.03.2025. On that day, the court did not grant an opportunity to the
defendants to file written statement to the amended plaint. In my opinion, the
defendants are entitled to an opportunity to do so. They are at liberty to file
written statement to the amended plaint within one month from today.
Defendant no. 1 states that she is suffering from cancer and she
has not been able to engage a counsel. She has been advised that she may
seek legal assistance from DLSA.
Ld. Counsel for defendant no. 5 submits that he does not have
copy of the amended plaint and that he may be provided the same.
Ld. Counsel for plaintiff submits that he will provide the same to
the Ld. Counsel for defendant no. 5 during the course of the day.
