Reply has been filed against the protest petition by the IO
whereby it is submitted that as per investigation, no public person was present
at the scene of alleged offence. It is submitted that no evidence was found
regarding the verbal castist remarks and assault.
It is submitted by complainant that inadvertently, the date of
incident regarding the castist remarks was wrongly mentioned. He has further
submitted that the correct date was orally mentioned to the IO. After some
arguments, Ld. counsel has submitted that the public persons now not
supporting him, hence, he is not pressing the protest petiton against section
3(1)(r)(s) SC/ST Act.
Considering the submissions of the parties and after going
through the record, as no case is made out against SC/ST Act and remaining
sections pertains to Judical Magistrate trial, the file be sent to Ld. CJM, North
West for further proceedings.
Parties are directed to appear before the concerned CJM on
10.11.2025.
