Sh. Sidhant Garg and Ms. Navita Gupta, Ld. Counsels for the
defendant with defendant.
Summons for appearance have been served upon the defendant on
21.02.2025 and 22.02.2025 respectively on his both addresses. Leave for
appearance along with an application for condonation of delay and
Vakalatnama has been filed on 17.03.2025. Copy not supplied.
It is submitted by Ld. counsel for the defendant that the defendant
being a layman was not aware that the appearance had to be filed within 10
days of service. He contacted the Ld. counsels on 12.03.2025. From
13.03.2025 till 16.03.2025, there were court holidays. Hence, the appearance
was filed immediately on 17.03.2025. It is submitted that the delay was not
deliberate and same may be condoned.
Same is objected to by Ld. counsel for the plaintiff. However, in
the interest of justice, allowed subject to cost of Rs.1,000/-.
Ld. counsel for the plaintiff submits that he shall move an
appropriate application for issuance of summons for judgment. Same be filed
within 2 weeks along with PF, upon which summons for judgment be issued to
the defendant on filing of PF within 07days for 05.07.2025.
