Fresh suit for recovery of Rs.28,60,000/- (Rupees twenty eight lacs sixty
thousand only) along with interest received by way of assignment.
It be checked and registered.
Present: Ms. Priya Wadhwa, Ld. counsel for plaintiff through VC.
As per directions of Hon'ble High Court of Delhi vide
Notification No.86/G-4/Genl.-I/DHC, dated 08.09.2026, whereby
11.09.2026 & 12.09.2026 were declared as Holidays, the matters of three
dated, i.e., 11.09.2026, 12.09.2026 and 14.09.2026 are being taken up today.
Heard. Record perused.
The plaint is not signed on each page by the plaintiff. Ld.
counsel for plaintiff submits that AR of plaintiff shall appear before the
court on the NDOH and sign on each page of the plaint.
Ld. counsel for plaintiff submits that the matter could not be
settled in the pre-institution Mediation proceedings. The certificate of Non-
Starter Report dated 22.07.2026 is on record. The Statement of Truth is also
on record.
Ld. counsel for plaintiff has highlighted Clause 6 of the Memo of
Understanding dated 10.11.2025 and submitted that Directors of defendant
No.1 company are also personally liable.
Issue summons for settlement of issues in the matter against
defendants on filing of PF/RC, etc., through all permissible modes,
returnable for 23.01.2027. Steps be taken within 15 days from today.
AR of plaintiff is directed to appear on the NDOH.
E-summons be also issued in the matter against defendants on
filing of e-mail addresses of defendants with PDF of the entire case file.
