Arguments heard.
It appears that the appellant has not filed proper court
fee on the appeal. In terms of Article 1 of Schedule 1 appended
to Court Fee Act 1870 as applicable to Delhi, the appellant is
required to pay full amount of court fee on memorandum of
appeal. In the suit the appellant had prayed for declaration in
consequential relief which was to fall within the ambit the second
proviso appended to Section 7(4) of Court Fee Act 1870 as
specifically amended in Delhi and therefore the
appellant/plaintiff is required to make a valuation at the market
value of the property for which he wants such declaration with
consequential relief of injunction. Naturally, the same amount of
valuation would have to be done on the memorandum of appeal
also. The appellant however has not shown as to how he has
valued the appeal.
Subject to filing of deficient court fee on the appeal, let
a notice be issued to the respondent on filing of necessary
PF/RC.
