Transfer application finds mention of two civil suits
pending in two different Courts of Ld. District Judges but copies
of complaints of these two cases have not been placed on record
with the paper book of the transfer application.
How is the transfer application maintainable in the
present form?
Applicant/Counsel may file brief written submissions
in not exceeding three pages in one week time period.
At this stage, Ld. Counsel for the applicant/petitioner
has given statement at Bar to withdraw the present transfer
application as it is suffering from technical defects; with liberty
to file afresh.
Accordingly, the transfer application is dismissed as
withdrawn with liberty as prayed for.
Transfer application be consigned to Record Room.
Copy of this order with Trial Court Record be sent to
the Ld. Trial Court.
