Submissions heard.
Summons under Order 37 CPC be issued to the defendant for
appearance on fling of PF and sufficiently stamped envelope through all
modes on taking steps within 30 days returnable on 06.01.2027.
Perusal of plaint shows that plaintiff had given a friendly
financial assistance in the sum of Rs.44,00,000/- (Rupees Forty Four Lacs
Only) to the defendant in cash in March, 2024. Since in the present case, a
transaction of more than Rs.2 lacs has been taken place in cash,
accordingly, in view of the directions passed by the Hon’ble Apex Court in
the case titled as “The Correspondence, RBANMS Educational Instituion
Vs. B. Gunashekhar and Anr. SLP (C) No.13679 of 2022”, let an
intimation be sent to the jurisdictional Income Tax Department to verify the
said transaction. Ahlmad is directed to send copy of this order sheet and
memo parties along with intimation.
