of Indian Evidence Act has been filed. However, declaration u/o.
11 Rule 6 (3) CPC has not been filed. Let the same be filed
within a week.
Upon filing of deficient documents i.e. declaration
u/o. 11 Rule 6 (3) CPC, let Summons for settlement of issues be
issued to the defendant on filing of PF, RC & requisite Copies.
Steps be taken within two weeks.
The Summons for settlement of issues of the Suit be
issued to the defendant(s) under Order V Rule 5 CPC 1908 with
the mandatory endorsement “defendant should file his Written
Statement of defense within 30 days from the date of
service/receipt of summons alongwith Statement of Truth and
Affidavit of admission/denial of documents of the plaintiff, as per
Commercial Courts Act, 2015”.
