This is a fresh petition u/s 34 of the Arbitration & Conciliation
Act, 1996 which was received earlier. It be checked and registered.
Present: Sh. Harshit Aggarwal, Ld. counsel for petitioner through
V.C.
Sh. Ashish Verma, Ld. counsel for respondent through V.C.
Ld. counsel for respondent submits that he was having prior
notice of the petition, therefore, he is appearing today.
Ld. counsel for petitioner submits that the award is against
the petitoner and there is petition u/s 34 of Arbitration & Conciliation
Act, 1996 and other application u/s 36 of the said Act is also filed.
Ld. counsel for petitioner submits that since the petitioner is
MSME, therefore, there is mandatory provision to deposit 75% of the
awarded amount. A separate application for depositing 75% award
amount is also pending.
Heard. Now, the petitioner is directed to deposit the 75% of
the total award amount within two weeks from today before the court
and, thereafter, the Civil Nazir is directed to deposit the said amount
immediately in the bank so that there is no loss of interest.
Ld. counsel for petitioner has submitted that the petition has
been filed within 90 days of the receipt of the award.
Ld. counsel for respondent submits that he has not filed any
execution petition so far concerning the award in question. It is prayed
on behalf of respondent that legible copy of the petition may be supplied.

Petitioner is directed to supply the same to the respondent within three
days from today. Reply to petition be filed by respondent within four
weeks thereafter with spare copy for other party.
Now put up for consideration/arguments on 01.10.2026.
Meanwhile the original arbitral record be summoned.
Petitioner to take proper steps in this respect.
