This is a fresh suit received by way of assignment. It shall be checked and
registered as per law.
Present : Sh. Munesh Chauhan, Ld. Counsel for plaintiff through V.C.
Arguments are heard.
Issue summons of the suit for settlement of issues and notice of
accompanying application for service upon the defendant on filing of PF and
RC/speed post returnable on next date of hearing. PF be filed within seven days
from today.
In case of refusal of summons, the process server is directed to
furnish his affidavit regarding the proof of service or to appear in the court on the
next date for recording of his statement. Ahlmad is directed to make an
endorsement on the summons accordingly.
The defendant is directed to file their written statement within 30
days from the date of service of the summons. Endorsement be made on the
summons accordingly.
Plaintiff submits that fresh summons be issued to the defendant to be
served by dasti mode.
At the request of plaintiff, it is directed that representative of the
plaintiff is permitted to accompany the process server at the time of service.
Endorsement be made on the summons accordingly.
