Today, the matter had been kept for arguments u/o 12, Rule 6 CPC on the ground that defendant in the WS has not disputed the ‘landlord-tenant’ relationship and the rate of rent, however, at this stage, after advancing arguments, two new applications have been filed by the defendant, one u/o 6, Rule 17 seeking to amend the WS to incorporate a dispute with regard to the identity of the suit property. In the second application, some unregistered documents are sought to be placed on record. Copies of both these applications have already been supplied to Ld. Counsel for the plaintiff. Let replies, if any, to these applications be filed within two weeks from today with advance copies to the other side. It is hereby ordered that defendant shall deposit rent/damages at the last paid amount in respect of BB-4, which is now sought to be disputed in court, on or before 10th of each English calender month in the name of of this court.
