By way of application the plaintiff is furnishing the
valuation of the reliefs prayed in the suit. As the valuation is a
necessary ingredient of a plaint and that the suit is at its initial
stage, the application is allowed and the amended plaint filed
with the application is taken on file.
The consolidated value of the reliefs claimed in the
suit is beyond the pecuniary jurisdiction of this court. In the facts
where this court lacks pecuniary jurisdiction to try and entertain
the suit, the plaint is ordered to be returned under Order 7 Rule
10 CPC to be filed before the court having jurisdiction.
The plaint in original with the court fees after
endorsement be returned to the plaintiff or authorized counsel as
per rules.
Remaining file be consigned to record room.
