Bail Matters 1473/2026
SAPIT ALIAS SHEIKH SAFIK Vs. STATE
FIR No. 03/2026
PS (Azadpur Metro Station)
20.06.2026
Present : Sh. K D Pachauri, Ld. Addl. PP for the State.
Sh. Jagjeet Singh Sangwan, ASC Metro in person
Sh. Ramesh Kumar, Security Inspector Metro in person.
Sh. Gulab Singh, IO PS Azadpur Metro & HC Anil Kumar
is also present.
Sh. Puran Chand, Security Inspector Metro is also present.
Ld. Counsel for applicant/accused.
1. This is an application under Section 483 BNSS for grant of bail,
moved on behalf of applicant/accused Sapit @ Sheikh Safik.
2. It is submitted by ld. Counsel for applicant/accused that applicant
is in JC since 98 days i.e since 12.03.2026. It is submitted that applicant
has been falsely implicated in the present case and there is no
requirement of custodial interrogation. It is also submitted that evidence
is already secured and and previous cases are not a bar to grant bail. It is
also submitted that there is no possibility of influencing witnesses and
trial is likely to take time and applicant undertakes to abide by all the
conditions imposed upon him.
3. It is submitted by the Ld. Addl. PP for the State that the offence
alleged is dangerous to public at large and due to such act of applicant,
-- 1 of 3 --
there could have been a major accident in metro and that bail should not
be granted to him.
4. Heard. Perused.
5. Undoubtedly offence alleged is a serious one as the same affects
public at large but in the present case, various loop holes have been noted
which create serious doubt about the involvement of the applicant. In
this regard, various queries were made to IO and metro officials but no
sufficient reasons were given by them. There is no proper explanation as
to how the other accused persons had run away from the spot carrying
approximately 200 meter of wire each weighing approximately 32 kg (as
per the submissions of the metro officials). The applicant/accused is
leaving in the vicinity from where he was allegedly arrested. There is no
explanation as to why he would not carry the alleged recovered wire to
his home instead of keeping it in the open & putting the same on fire. The
alleged area is accesible to general public & the alleged recovery of wire
was openly on the land visible to all. In such scenareo, the recovery at
instance of accused is doubtful. The wire is allegedly recovered from an
open place just few meters away from the metro compound. It is also
doubtful that after having stolen the alleged wire, the accused would still
remain there for few hours so making it convenient for the metro officials
to arrest him. Admitedly there is no CCTV Footage regarding the
alleged theft of wire. Whole of the case rests on the disclosure statement
of the applicant.
6. In such scenareo, the applicant is granted bail,
applicant/accused is admitted to bail on furnishing personal bond in sum
-- 2 of 3 --
of Rs. 20,000/- with one surety of the like amount subject to the
satisfaction of Ld. MM/Duty MM/ Link MM subject to the conditions
that:
(a) Applicant/accused shall not commit the same offence again & must
not threaten the witnesses;
(c) Applicant/accused shall provide his fresh address by way of an
affidavit in the Court after his release and in case of any change in his
address shall inform the Court;
(c) Applicant/accused shall appear on each and every date of hearing
before the Court.
Nothing in this case shall tantamount to merits of this case.
7. Application stands disposed off. Copy dasti. Copy of this order be
also sent to Jail Superintendent.
